  • Sale Deed Cancellation: A sale deed cancellation is the legal process of voiding a registered sale deed. This may occur due to mutual agreement between the parties or other legally recognised reasons, such as documentation issues or the failure of the transaction to proceed.  
  • Registration Charges: Registration charges are fees paid to register property-related documents with the relevant authority. Unlike stamp duty, these charges are generally non-refundable, although the applicable rules may vary by state. 

How Stamp Duty Works  

Stamp duty is a state government levy applicable to property transactions. It is generally calculated on the higher of the property's market value or the transaction value and must be paid before the sale deed is registered. The applicable stamp duty rate varies across states and may also depend on factors such as the property's type and location, as well as the buyer's category, such as an individual, woman, or company. 

How is Stamp Duty Calculated on Property Transactions?  

In Maharashtra, the calculation is guided by ready reckoner rates published annually by the authorities. The higher of the agreement value or government-assessed market value becomes the basis for stamp duty calculation.  

What Happens if You Cancel a Recent Property Purchase? 

If a property transaction is cancelled after stamp duty has been paid but before or after registration, the buyer may file a refund claim. The cancellation must be documented (via a Deed of Cancellation or court order), and the refund application should be made within a 6-month window from the date of cancellation. 

What is a Sale Deed and What Does Cancellation Mean? 

A sale deed is a legally valid document that records the transfer of ownership of a property from the seller to the buyer. 

Sale deed cancellation is the legal process of nullifying this transfer, either through a mutually executed Deed of Cancellation or by way of a court order or other legally recognised process. Once cancelled, the original sale deed ceases to have legal effect, subject to the applicable laws and procedures.  

Process of Cancelling a Sale Deed — Step by Step 

  • Prepare a Deed of Cancellation: Draft a Deed of Cancellation and ensure it is signed by all the parties involved in the original transaction.  
  • Register the Cancellation Deed: Register the Deed of Cancellation at the same Sub-Registrar's office where the original sale deed was registered.  
  • Preserve Supporting Documents: Keep copies of both the original sale deed and the registered Deed of Cancellation, as they are typically required when applying for a stamp duty refund. 

Stamp Duty Refund Process for Cancelled Sale Deeds 

As per the Maharashtra Stamp (Refund) Rules, 1963, a refund of stamp duty is allowed if: 

  • The deed is cancelled by mutual agreement or court order. 
  • The refund claim is made within 6 months of cancellation. 
  • The original stamped document is submitted along with the claim. 

If your property purchase has been cancelled, reclaiming the stamp duty paid is possible but only if the process is followed accurately and within the prescribed timelines. The Maharashtra government allows refunds for eligible cancellations, provided all documentation and conditions are fulfilled. Documents required for Stamp Duty Refund in Maharashtra

You generally need to submit the following documents when applying for a stamp duty refund in Maharashtra:

  • Original stamp duty document/stamp paper (for which refund is being claimed)
  • Original stamp duty payment proof (e-SBTR/e-challan/MTR-6)  
  • Self-declaration/Affidavit as required in the refund application form  
  • Copy of registered document (if refund is for a cancelled registered instrument)  
  • Cancellation deed/proof of cancellation (if applicable)  
  • Copy of the original document 
  • Cancelled cheque or the first page of the bank passbook clearly showing the applicant’s name, account number, bank name, and IFSC code 
  • PAN Card Copy of the applicant  
  • ID Proof of applicant (e.g., Aadhaar, Passport)

Steps to Claim Stamp Duty Refund through the IGR Portal 

To apply for a stamp duty refund in Maharashtra, follow these steps: 

  1. Check the Application Timeline: Ensure you submit your refund application within the prescribed time limit from the date of stamp paper purchase or cancellation of the document, as applicable under the relevant rules.  
  2. Visit the IGR Maharashtra Portal: Access the official website of the Inspector General of Registration (IGR), Maharashtra.  
  3. Start a New Application: Accept the terms and conditions and select 'New Entry' to begin the refund application process.  
  4. Verify Your Mobile Number: Enter your mobile number, authenticate it using the OTP received, and complete the CAPTCHA verification.  
  5. Save the Refund Token Number: After successful verification, the portal will generate a refund token number. Keep this number safely, as it is required to track your application.  
  6. Complete the Application Form: Provide your personal details, address, bank account information, and details of the document, including whether it was registered.  
  7. Specify the Reason for the Refund: Clearly mention the reason for claiming the refund, such as cancellation of the transaction, unused stamp paper, or any other applicable ground.  
  8. Upload the Required Documents: Attach all supporting documents, such as proof of stamp duty payment, details of the stamp paper, the cancellation deed (if applicable), affidavits, and any other documents specified by the authority.  
  9. Submit the Application: Review the information provided, submit the application, and note the acknowledgement number generated for future reference.  
  10. Submit Physical Documents, if Required: Depending on the nature of the application, you may be required to submit physical copies of the application and supporting documents to the office of the Collector of Stamps.  
  11. Track Your Application: Use your refund token number and password to monitor the status of your refund application through the IGR Maharashtra portal.  

When Can You Claim a Stamp Duty Refund? 

You may be eligible to claim a stamp duty refund in Maharashtra if a property transaction does not proceed or the related document becomes invalid under the applicable rules. For example, a refund may be available if the stamp paper or e-stamp certificate remains unused, or if the agreement is cancelled before registration. In certain cases, a refund may also be permitted where the document is considered legally void, meaning it has no legal effect from the outset, subject to the provisions of the relevant stamp laws.

How is Stamp Duty Refunded in Maharashtra

In Maharashtra, once your stamp duty refund application is approved, the refund amount is credited back to your bank account electronically. The approved refund amount is then transferred directly to the applicant’s bank account through electronic means such as NEFT/RTGS or direct bank transfer. For this reason, you must provide accurate bank account details (such as account number, bank name, IFSC code, and a cancelled cheque or passbook copy) when applying, as these details are used to credit the refund.
